Mr. Justice MacKinnon, in the King's Bench Division, recently, held that an insurance company

entitled

repudiate not lability because an insured per- son has not disclosed previous claims made against other com- panies, or refusals by other com- panies, when effecting a policy.

The defence claimed that an in- surer was bound to disclose this without anr question on the matter being asked.

His Lordship granted to Mr. Albert Edward Ewer, of Mare- street, E, declaration that are insurance held by him in respect of a garage and contents at Whiston-street. Haggerston, E., was valid and subsisting..

The defendants were the National Employers' Mutual Gene- ral Insurance Association. Limited. St. Mary Axe, EC. who had in- sured the property for £6,100, fire occurred at the premises in May, 1935, in respect of which Mr. Ewer claimed £1,123 25. Bd., and the insurance company repudiated

The company alleged that. Mr. Ewer had fraudulently exaggerat- ed his claim and that, under the terms of the policy, the company were not liable. They also con- tended that Mr. Ever had falled to disclose that he had pre- vlously claimed on insurance com- pantes, and the other companies had declined to grant or continue policies,
