Winding Up Petition Dismissed

At the Bankruptcy Court on "Saturday morning. His Honour the Chief Justice, Six Atholl MacGregor dismissed a 'petition for the wind- ing up of the Wah Keung Engi- neering Company. Hils Lordship held that any one partner, without the knowledge and consent of his Tellow partners; could not bind them to a bankruptcy petition.

Silva watched the case on behalf of one of the partners in Canton and Mr. Peter H. Sin represented the largest creditor.

Mr. Loseby said that the debt had been proved at the last bear- ing, when the suggestion was made that the debtor firm and one of the creditors were colluding. The question also arose as to whether one of the several partners could fle the petition on behalf of the Arm and Mr. Loseby said that as he held that could not be done. he advised the partner concerned to get one of the creditors to file the petition, which was accordingly done.

If indeed that was collusion, then there had been collusion.

Lau Man-kin. under cross- examination by Mr. Silva said that the firm owed him about $800 and he did not press for payment be- fore because he had hoped that the arm would be able to find a good footing again.

Three women were charged be- tore Mr. W. Schofield' at the Cen- tral Magistracy, on Saturday, for keeping unregistered mul taai at 13, Fung Fat Terrace, on October 10.

Mr. Leo D'Almada senior, ap- peared for the defendants, while Inspector H. W. Fraiser prosecuted.

The first defendant was charged with keeping an unregistered mui tsu, Kai Chau Wal.

Detective Inspector Ellis, attached to the Secretariat of Chinese Af- fairs, prosecuted.

The prisoner told the Court that the girl had told him in July, 1935 She that she was 17 years old. followed him to Swatow of her own free will.

Det.-Inspector Ellis" stated that the girl formerly resided at 164 On Chau Street with her mother until July 23, 1935, when she dis- appeared from home. "Her mother made enquiries and was told that her daughter had gone to Swatow with the defendant. She travelled

to Swalow and made her report to the police there. In October the same yet she received x com- munication from the Swatow police asking her to go and get daughter.

The Court granted a remand.
