"GOLD DOLLAR

CLAUSE"

[Special to the "Hong Kong Daily Fress" (Copyright.)]

Leipzig, Nov. 13.

An exceedingly important deci- gion has just been pronounced by the Reichs highest court of appeal in Leipzig which rules that all loans, bonds and mortgages based

the so-called "Gold" dollar clause" must meet interest amor- tisation at the rate of one dollar equivalent to 4.2 marks. This de cision, was arrived at a test case concerning the Krupp bonds and the Hanover provincial loan, but it is considered as applying to all- other similar cases now in "abey- ance notably that of Vereinigte Stahlwerke that is the German Steel Trusts which is said to have | accumulated reserves for the pur- pose of meeting arrears, interest, and claims in the event of the appeal court's decision favouring the bond holders.

In a statement accompanying the decision explaining the motives for the judgment being given; the court declares that mention of the American dollar did not make the transactions into a dollar loan, the conditions printed on the loan certificates clearly stating that repayrnent was to be in German Reichsmarka ya Transocean Kuo Min.
