ECHOES OF 1859

51-Sequel To A Libel Action

(Continued)

A

of National Jurisprudence. thought struck us that this wor thy citizen might have pecuniary intentions in view, because he had stated during one of his lucid. intervals in

morning, that'

Mr. Bernardino Fernandes of Macao, having, sworn an affidavit on which a rule nisi was moved against the Daily Press for libel, an article on his

the activities in Macao Was published in this paper on June 17, 1859. The first portion of it, was reprinted yes- terday. Below is the continua- tion:-

"

"Our fat friend Chico de Silva procuring the loan of these two documents, went gudding about the city on Sunday morning with them, like a hen with one chic- ken, only instead of cackling, be laughed. We sadly fear that he must have entirely neglected his devotions, a circumstance which would appear to have struck him later in the day, for he lent the documents to a friend for half ал hour, whilst we suppose, ho went to confession. At this stage of the business the matter came to our knowledge. As Chico is the employee of Chun Ahoy, it was very clear that he had entire control over these documents, and consequently attack in due

form was made on Chico for the loan of them In this we regret to state we signally failed. Chico admitted that he had such docu- ments, and that the. farewell address required a Philadelphia lawyer and an Irish jury to re- cancile them to Bernardino's amdavit—but Chico did not know from whom he had obtained the papers, and could" not tell to whom he had returned thein. but it was to a Chinaman who kept a shop. Chico's love of truth and Justice was appealed to, but he was proof against the appeal. He said: "English law not the same Macao law-you English law nothing to do long me" and then he would laugh at this effusion

|

Bernardino would give 85,000 for the papers. However, be that as it may, we could not get them, and when Chico's "amor patrise" was evoked, we regret to say that he commenced abusing his coun- trymen in a style that would have done credit to Bellico Nebu- leus. What they have been doing him, or he to them, Lord. knows. He lives in A house as long as a street all along by him- self, but this is clearly his own fault, for he said he could get married whenever he pleased,

ta

We cannot think' that the law which admits of a criminal in- formation for libel being filed by

Judge is applicable in a case of this kind. If the Portuguese of Macao were as debased as our fat friend Chico, or our contem- poräry, or Bernardino appears to consider them to be. it would be.. next to impossibility to procure evidence at all. Therefore in that event, the Queen's name would be used for the suppression of evidence, and the perpetration of justice. If the matter were allowed to go before a Magistrate, the prosecutor would have to appear in a box-partles could be compelled to attend as witnesses, and evidence would be elicited. In point of fact, the rules applied for, places Hongkong at the pro- secutor's disposal and shuts out the defendant from Macao, where alone the evidence is to be had In a suit of "nise prius" 'this 'could not happen, because A commission would be appointed to take evidence in · Macao-a proceeding which we imagine the Crown cannot very well resort to.
