the part of the defendant, Com. mander Newill, R.N., Acting Har bour Master dismissed the sum- mons against Ip Kau, coxswain of the Yaumat ferry launch Man Chung, at the Marins Court. Defendant, represented by Mr. F. H. Loseby, of Messrs. Russ and Co, bad been charged with having been underway without a regulation port side light on Sept.

"It is clear that the light did go out when defendant was under way, und he made an attempt to put it right If there had been a colision on anything of that kind. he would have been responsible for the consequences, whether he wil fully put out the light or not; but As it was I think I have to dismiss the summons," said the Marine Magistrate in discharging the de- fendant.
