FAILURE.

RECOGNITION LATER IN POLICE COURT.

"The trial of two men at the Cri minal. Sessions before the Chief Justiça (Sir Joseph Kemp) and a jury, which was adjourned last Wednesday awing to the Christmas holidays was resumed yesterday when previons witness was fur ther cross-examined and denied an allegation that the first-accused was struck by Ewes Chinese constables at the time of his arrest,

Chang King Man and Li Fat are accused of boing members of a ganz of five men who carried out a roh bery house in Kak Hang Vil Ing. Kowloon City, on October 18. They are defended by Mr. Hing Rhing Lo, while Mr. Somerset Fitzroy is for the prosecution.

Continuing his evidence unde eross-examination, Kwok Chun, an inmate of the house, stated that he went out with two Chinesa detes tives two days after the robbery with the intention of looking for the robbers and not for any parti eular man. After they had been walking for three hours witnes came across the first accused in the street and pointed him out to the detectives as one of the robbers.

"All Dressed Alike.”

A woman inmate of the houne stated in her evidence that she re cognised the first accused as the man who had tied her up and removed her ear-rings.

In answer to Mr. Lo, witness ad- mitted that she did not recognis prisoner at the identification parado held threg dave after the alleged robbery, but that she was able to recognise him in the Police Court some 27 days later.

Witness explained that she was unable to recognise prisonet at the parada owing to the fact that he was among R nuinbar of men all dressed alike. When she identified him at the Police Cours the was able to recognise him by his fea tures and not by his clothing

Another woman witness explaje. ediat she was unable to identifu the two accused in the first in- shane, owing to it being dark at the time the parole was held. "Wi ne said that she reconnie the first acoused in the Police Court the man who tied her up and the second accused na the ran wi' was carrying a chopper for open- ing boxes and cther property.

Unrecorded Statement. Mr. Lo put it to the witness that no record had, been, made by tha Magistrate of any statement by witness that the second was a men- ber of the gang.

Witness repeated that she had stated that second accused was al63 there at the time of the robbery.
