SEQUEL TO HIGH COURT DECISION.

PROPRIETORS DECIDE TO

OPEN

London, December 8.-To-morrow many thousands of people will be attending einema performances which have been declared by the High Court to be illegal. Yester day the London Cinematograph Exhibitors decided unanimously that cinemas which have been open on Sundays should continue to open intil some new development accurs,

The High Court's decision that. the London County Council-and consequently any other local authority has no power to permit the opening of cinenins on Sunday, since this is illegal under the Sun- day Observanes Act of 1780, becomes operative in fourteen days. Next week, presumably, London County Council will decide whether to ap pen against the decision.

At a special meeting of the Lon- don and Home Counties branch of the Cinematograph Exhibitors' Association it was unanimously decided to open cinemas, as usual on Sundays. The members were unanimous that they would con- tinue their contributions to the various charitable institutions to" Fabich they had been in the habit of regularly contributing from the proceeds of previous Sunday einematograph performances. An official of the Provincial Cine- matograph Theatres, Ltd, which controls, among others, the Tivoli and New Gallery Cinemas in Lon don, stated that the exhibitors' decision meant that Sunday per formances would be given indefinite ly or until some new development

occurred.

But in any event the matter is to be carried farther, for the organiza- tion of West End theatre and music- ball interests known as the Enter- tainment Protection Association (which brought Thursday's test case) is calling a conference, of theatre and cinematograph interests to consider joint action in pro- noting in Parliament à bill (which has already been drafted) legalise the opening on Sundays of places of entertainment.

The bill, as drafted, provides for its application to the administra. tive county of London and to any other county or county borough in England, after adoption thereof by resolution passed at the meeting the appropriate licensing autho- rity" and empowers the Sceretary of State to make regulations con- ceraing employees.

Such a measure would, of course, be vigorously opposed by the or- ganisations for the safeguarding of Sunday observance and other re- ligious bodies. As was pointed out yesterday, it is claimed that the Prime Minister is pledged against the introduction of any measure of the kind, and 261 M.P.'s are. pledged to resist any private mem- ber's bill.
