The defendant in the case, cited as Mak Chun Loong, claims that he is Ng Shing himself. He maintain- ed this attitude when he was charged at the Criminal. Sessions in April last year.

He said that since the last adjournment he had been to the country to raise funds with which to pay for legal advice. his return" he had consulted solicitor in order to prepare his defence, but this had not been possible owing to the short time he had in which to do it.
Mr. Sheldon opposed the applica- tion, painting out that the defend- ant had had ample time to le his defence. Counsel also pointed out later that his Lordship allowed de- fendant to speak at the last hearing, which was a very generous conces- sion, as he had no right to speak without fling a statement of his
dotence.
L:
His Lordship pointed out to the defendant that witnesses had come from Canton, at the expense of money and time, to give evidence for the plaintiff. If an adjournment were granted, it would mean that de fendant would have to pay the extra costs. His Lordship decided to pro- ceed with the case, saying that if there were strong grounds, an ad- journment would be allowed later.

PHIN SOON CASE.
JUDGMENT GIVEN AGAINST
LIQUIDATOR.
In the Supreme Court, Penang, on May 5, Mr. Justice Sproule gare judgment in the, third party issue between the Malay Siamese Pros pecting Co. and the Phin Soon Tia Dredging Co., in connection with the case in which Mr. A. J. King, a well-known mining engineer, sued the Malay Siamese Prospecting Co. for $12,000 odd as alleged, balance of salary due bim as managing director of the Phin Soon concern.
Mr. Terrell appeared, for the Malay Siamese Co. and Mr. Hume for the liquidator of Phin Soon.

"Archie" Jackson, who will open with Woodfell if all proceeds ne cording to plan, is the most stylish and finished batsman Australia bas produced since poor Vietor Trum- per's time.. He has been carefully coached by Allan Kippax, and only requires English experience to be the best batsman in Australia, He finished the last Australian season with an average of 75.87, "made in nine innings. His highest score
was 187.
Recapitulating the facts, his Lordship said that Mr. King was engaged by the Malay Siamese Co. to be a kind of general manager for Allan Kippax, who will be in first a group of mines, one of which was wicket down, has been a grant Phin Soon, "under a merger agree, ment dated December 8, 1926, and cricketer for many sensors. י,
Phin Soon was in a precarious con- dition at the time and things got worse instead of better. Phin Soon had never been able to pay the Monthly levy out of which Mr. King and the other joint officers of the group were to be paid by the Malay Siamese Co. ns managing agents for the group. Mr. King, therefore, in accordance with the merger agree- went, did not draw the Phin Soon
share of his monthly salary

Concluding a long judgment, his Lordship held that there was daty upon the Phin Soon liquidator to make good to the Malay Siamese Co. what they had to pay Mr. King for his salary for his work for Phin Soon. His Lordship accordingly gave judgment against the liqui dator with costs to be taxed.
Mr. Hume made application for stay of fourteen days, which was allowed.-Straits Times.
