H.M.Ş. “DAUNTLESS."..

COURT-MARTIAL ON CAPTAIN

MACPHERSON...

SIMILARITY OF TWO BUOYS.

PORTSMOUTH, August 6th. A second Naval Court-martial arising out of the grounding of H.M.S. Dauntless at Halifax in this case for the trial of (N.S.) on July 2nd, at here to-day,

Captain K. D. W. Macpherson, who was in command of the ship. The Court was composed as follows:

Captain D. B. N. North (Prési dent), Captain C. A. Scott, Captain Max K, Horton, Captain J. S. C. Salmond, Captain W. G. C. Max well, Captain J, C. Torey, "Captain R. R. Turner, Captain H. H. Rogers, and Captain L. V. Wells, with Paymaster Captain H. 8. Measham, Deputy Judge Advocala of the Fleet. Captain J. A. G Troup, H.M.S. Cairo, again pro-

secuted.

The charge against the accused was that on July and laat he did negligently or by default suffer H.M.S. Dauntless to be stranded. The accused, who pleaded "Not Guilty," had as his "friends" Captain D. B. Le Motté and Pay- master. Commander C. C. Merry.

The circumstantial letter describ- ed how the Dauntless grounded in A fog on the Thrumcap Shoal while steering a course of 333deg. This course was being steered in error, the correct course to the Neverfail Shoal Bell Buoy being 335deg. The couree was not checked by the captain. It was cortended that Captain Macpherson was to blame for the accident, (a) in not check- ing the course (335deg.) between the time of rounding the whistle buoy aff the south-west end of Pariuguese Shoal and the time of next altering course about 2.2 p.m.; (b) in pass ing northward of the Thrumeap Shoal Buoy without identifying and locating; and (e) in not utilize ing the information of shosling water provided by the leadamen and the leading seamen at the sounding machines.

Navigating Dicer's Evidence. Lieut. Condr. T. R. Beatty, who was navigating officer of the Daun- tless. was called.

any

Was the captain left in doubt as to the course of the ship asked the prosecutor. So far as know," replied the witness, "the captain knew we were of course

335."

1.

The witices put in the chart by which the ship was being navigat ed at the time, she grounded, and was questioned about the track shown on this. He explained that the line showing the actual track of the ship was drawn for the pur pozes of the Court of Inquiry. The witness thought the captain under- stand that the course being steered would take the ship to the west. word of the Neverfail Shoal Buoy The buoy sighted just before grounding corresponded with the Neverfail Shoal Buoy, as it was described in Sailing Directions The soundings taken also agreed with the ship being north-west of this buoy. The buoy was not fixed by land objects, as none were in sight. There were no other means of fixing it other than by dead reckoning and soundings. Both of these pointed to its being the Neverfail Shoal Buoy.

Questioned na to whether the Thrumcap Shoal Buoy could not have been located easily by dend reckoning, the witness aid it could if he had plotted the course 335 on plotted the course 338, and it was upon the latter track that he was working.

Ship Across Bows. Cross-examined by Captain Mottée, the witness said a pilot schooner with an auxiliary motor loomed out of the fog and crossed the bows of the Dauntlete from port to starboard, and the cruiser had t go full astern to avoid collision. The schooder was in the wrong The pilos vessel had three masts and was larger than a drifter. When the witness adw that they were passing within a cable of the Portuguese Whistle Buoy be asked the captain whether the ship could be steadied on 355, and that was done. All proper precautions were taken in navigation the ship under the bad weather conditions that prevailed.

Neverfail Shoal Buoy on the chart, but he submitted that that precau- tion was one which any reasonably careful and capable officer would have omitted in the circumstances. There was no reason why he should not accept the course asked for by the navigating officer, in whom he placed complete confidence and trust, and whose reliability he had been able to test under all con, ditions. The exigencies of the mo ment were such that he (Captain Macpherson) would not have been justified in allowing himself to be distracted by checking the work of the navigating officer, especially work of such a simple and straight forward nature. that he was justified in remaining in a position to take immediate action if necessary, bearing in mind that he had already gone through the procedure for entering the harbour with the navigating officer and had questioned him as to the distance he expected to pass from Nevertail Shoal Buoy

The Buoys:

Dealing with the allegation that he failed to identify the buoy which he accepted as the Neveriail Shol Fuoy, Captain Macpherson said the buoy was reported to him chequer. ed. He closed the buoy to make certain, and the buoy appeared to him to be parti-coloured, and there was no doubt, in his mind that it was the Neverfail Shoal Buoy. The next course up the harbour as far as the Neverfail Buoy was then set, but before the ship was steadied To imply that he she grounded. did not confirm the colour of the buoy was incorrect. He submitted that the fault lay in the deteriorat ed. colour of the buoy, which render- ed it possible for a mistake to be made. He thought it an accepted fact that the shape of a buoy was more important than its colour. In this case the Thrumeap Shoal Buoy
