Mr. Hemmerde KC.. arguing the appeal for Edward Rowlands, contended that the jury were to inflamed by statements made by Lord Halsbury, K.C. (counsel for the Crown), that they acted upon evidence far too flimsy to support a case of the gravity of this one. Lord Halsbury had remarked that the prisoners never got on with Lewis." That not only was not. true but was in the teeth of all the evidence.

"I contend," declared Mr. Hem merdé," that counsel had no right to make that remark because it was faise and misleading, and there was no possible excuse for it."

"Lord Halsbury's Retort. Lord Halsbury: I cannot stand that. I must say at once that I had the statement of two witnesses before me that justified the remarks I made, but unfortunately they dia not say it in evidence.

Lord Halsbury: It seems to be a personal attack on me.

Mr. Hemmerde: My friend knows me well enough to know that I would make no personal attack on him. I have a duty to my client and, however unpleasant it is, I must do it.

Continuing, Mr. Hemmerde re. marked that Lord Halsbury' also stated: These men were out to put Lewis out of the way." The evidence WLS to the contrary— namely, that all the men were on friendly terms.

"I am certain the time will come, and the sooner the better, when people, before entering on matrimony, will have to produce sufficient evidence that, mentally and physically, they are fit to enter on the profession of parenthood,"

The court had been informed of the reason John Rowlands had not been present to hear the appeal. They were, however, only concern- ed with his condition at the time of the murder.

Driscoll and Edward Rowlands in the dock accepted the decision with apparent indifference. Dris coll took a hasty glance around the court and up to the erowded public galleries before he was removed to. the cells.
