THE JUDGE'S STRIKING COMMENT.
At Chester Assizes before Mr. Justice Branson, Albert Edward Davies, twenty-eight, a shipyard labourer, living at Pröctor·rand, Rock-ferry, was indicted for the murder of his daughter, Elsie, aged about four.
Considerable interes; was aroused in the caso owing to the fact that. the judge, in charging the Grand Jury on the case, said:-

According to depositions, it is a heart-rending story of a father, who, driven to distraction by the suffering of his child, takes upon "himself" to put an end to its suffering. I cannot avoid saying this about it, that it is a matter which gives food for thought when one comes to consider that had this poor child been an animal, instead of a human being, so far from there being anything blame- worthy in the man's action in putting an end to its suffering he would actually have been table to punishment if he had got done ITY OF DUNDEE
so. That is the state of law, and we must administer the law.
Mr. John Grace, M.P., prosecut ed, and Mr. Austin appeared för Davies.

The girl. Elsie, was one of five children. Early this year the mother, suffering from tuber- eulcsis and curvature of the spine, died. The girl also contracted tuberculosis, and early in June she developed gangrene-in-the face, following measles.
"Davies was in the habit of sitting up with the child all night, and he was much distressed. The doctor was of opinion that the child could not live long. On the night of July 9th, prisoner sat up all night with the child. The following morning Davies went to his mother-in-law'a house, telling her be had drowned Elsie, as he could not bear to see her suffering any longer,
He afterwards surrendered to the police, telling them he had put the girl in a bath. The police found the girl lying face downwards in nine inches of water. A touching
feature of the case, said Mr. Grace, was that, on the very day he gave himself up, the doctor, making his asual call at the house, had pro- vided himself with a blank certi- ficate in anticipation of the child's natura fate.
Medical Evidence.
Medical evidence was that the child's death was anticipated by the disease. She was in such a state that shock would have caused death if removed to hospital.
