The week-end shipping statement show- ed fairly good freights, although there was a decrease recorded with regard to that for ports beyond. Hongkong cargo, however, showed an increase in Sunday's return of over 2,000 tons, but yesterday was only just under 300 tons above that of Saturday.

Truclove was keeping a bad look-out and could have avoided the collision, but be held that the Viper could also have avoided it by sheering, so that both vessels were equally to blame,

The Court of Appeal reversed this judgment so far as it condemned the Viper. Being at anchor, she was entitled to act on the assumption that the Truelove would avoid her, until the very moment. when it became manifest that! she was not going to do so. If ber "danger"was revealed-in-good-time-then- she was bound to take whatever steps were possible to avoid the danger, and. although at anchor she was bound to keep a good look-out.

Expert evidence was to the eficet that. the master of the Viper, with the wea- ther and tide described, was entitled to assume that the Truslove was in control of her own course at a distance of 300 feet! or even at a shorter distance. There. fore, the toaster of the Viper had leas than a minute in which to decide what to do. In that space, of time he might by a slight change of heading hare re duced the force of the collision, or poss- ibly avoided it. But a master is not] bound to act correctly on the spur of the moment. He cannot be blamed it, owing to the fault of the other party, he has 'less than a minute for decision.

It would have been different, of course, if he had been warned in time that the Truslope was powerless to act, But he was not, so warned, indeed, his position was rendered more difficult: by the presence of the third barge, the Arrow, so that, the Truelove, which had not taken the proper steps to avoid a collision, was held wholly to blame.
