SHIP BROKER SUED.
NON PAYMENT FOR STEVEDORE WORK
CHINESE COMPANY SUCCEEDS.
At the Summary Court yesterday before Mr. Justice Wood, the Ming Kee Com pany of 3, On Lan Street, sued Mr. Finn Malu, ship broker, of China Building for 2900, being the amount agreed upon for stevedore work on the ss. President Cleveland on September 3rd last year. Plaintiffs also claimed costa
Mr. Finn Mam claimed for $300 against the Company for professional services rendered.
Mr. J. O'Donoghue, for the plaintiffs, said that his clients had contracted with the defendant for the work to be donu at the rate of 10 cents per ton. That was the contract rate. The work, however, was never completed, and at a subse quent interview "Mr. Fian Malm agreed, to pay $900 Plaintiffs were prevented from Enishing the work by the Dollar Line itself. At that time the plaintifa bad dealt with about 200 tons which work- ed out at 8171.
His Lordship asked why it was agreed to pay $200 when the work done should only have been 3171. -
Mr. O'Donoghue replied that the coolies had to be paid for the whole day. The plaintiffs bad actually paid $400 that day. Continuing.r. O'Donoghue and that when defendant was approached, he said he had not received anything from the Company and plaintiffs would have to wait. He agreed to pay $200.
Air. Finn Mal said that he had begun business some 10 months ago after having been 22 years on the sea. Plaintiffs con- tinually bothered him to secure the stevedore business of the Admiral When the Oriental and Dollar lines. business was eventually secured, plain tiffs did not help at all. Had the coolies done their work properly the business would have been retained, and plaintiffs would have made from $5,000 to 210,000 a year No one from the plaintiff com pany went on board to help in superia tending.
Plaintiff stated in evidence that only 200 tons were handled on the vessel. The charge was 10 cents per ton leas

His Lordship said that, it seemed to Sim to be reasonable to find for plaintiff's for 2162.45, that being 8171 less 5. per cent. discount. Mr. Finn Malm agreed.
In regard to his claim fer $300 for pro- fessional services rendered, he gave de tails of such services. These the Chinese Grm denied.
Judgment was given for the Ming. Kee Company.

Talks to be given during the session will include Mission- ary Work and First Aid and Symp toins." Chaperoning Necessary," Treatment of Native Servants," "The Influence of the Home on School Life," and "Sunday-it's Duties and Pleasures.
It has also been decided to hold a mienie at Taipo during the session, and a whole-day sewing party has also been arranged.,

Mra. Bernard, wife of the Hor. "Mr. D. G. M. Bernard, of Jardine, Matheson & Co., returned from Vancouver, accom- panied by her daughter.
Mrs. Hall, wife of Mr. Hall, of Jar- diae, Matheson & Co., also returned from Vancouver.
Mr. C. S. Gubbay and Mr. A. S. Gubbay.
Mr. McNab, who is a prominent official of the C.P.R. in Vancouver. He relieves Mr. Fetterly of the local office.
Mr. J. W. Parson, of the British American Tobacco Co., is back again from Vancouver, accompanied by Mrs. Parson.
A well-known business man from Aus- tralia, Mr. E. Bennet, accompanied by his wife and daughter, will stay in the Colony for some time and will later pro- ceed to Australia. The Bennet family is back from a tour around the world.
Mr. C. Thwaite, Oriental auditor of the C.P.. has returned from Yokohama. The Empress of Russia sails for Manila at five o'clock to-day, and returns to Hongkong next Monday. The liner leaves Hongkong again for Thursday September 16th.

At the China Auction Rooms yesterday afternoon, Mr. E. V. M. R. de Sousa, sold by order of the mortgagee, two lease- hold properties, situated at No. 6, Liberty Avenue and No. 2, Victoria Avenue, Ho Mun Tin, Kowloon.
The first property, No. 8, Liberty Avenue, at is held for the residue of 73 years from a lesse dated June 11th, ro. The area of the property is 2,444 square feet, and the annual Crown restal $18.
The upset price was 8,100, with bids of $100 acceptable. When the figure of $11,400 bad been reached the property was purchased for the estate of the late Mr. C. F. de Carvalho, whose death at Home was reported some time ago.
The second property, No. 2, Victoria Avenue, is held on similar terms to the hora. The area is 9,517 square feet, and the annual Crown rental $15.
The upset price was $7,000, with bids of $100 acceptable. The purchasers were the Sun Kwong Hop Company for 88,100.

Chen of Shanghai, during their short stay in Hongkong, are giving violin solos with piano accompaniment.
