DOCTORS MUST TELE. SECRECY PLEDGE-OVERRULED BY JUDGE
is a doctor exempt from disclosing in a court of law what happened be tween him and a patient at a clinic?
This question, which has been raised before in one form or another, was discussed before Mr. Justice Horridge. In the Divorce Court, London, an June 10th, the point was raised, în a case in which vinereal disease was in- volved, as to whether a doctor was compelled to answer questions put to him, or whether he could dealing to do so on the ground that his relations with his patient were - confdential and pre- tected by the principle of profesional. secrecy.
Before Mr. Justice Horridge a hu band petitioned for divorce from his wife. Mr. Grazebrook, "counsel for the htband, called Dr. John Elliott, of Chester, who bad treated the wife.
Mr. Barrington Ward, K.C., said he' wished to raise the question whether the doctor was bound to give evidenes.
The Judge asked whether any authority could be shown for counsel being heard marely on behalf of a witness.
Mr. Ward said he could got, where upon the Judge said he could not allow edunsel to be heard.
DOCTOR'S PRODUST.
Dr. Elliott, on entering the box, said he claimed the "privilege of doctor and patient," and he asked to be relieved from the necessity, of giving evidence. Bo asked the Judge to exempt him from. giving evidence, as to the penereal dis case of a patient.

The Judge said there was no privilege for a doctor in a court of law. Ho ordered the witness to answer the ques tiona..
Dr. Ellictt replied that he and other medical men who formed a clinie ander- took the duties on the distinct. under- standing that professional secrecy as to what happened there would be observed and upheld by the Ministry of Health.
The Judge: I am sorry, but the Ministry have no power affecting the jurisdiction of these Courts. Doctors are subject to the orders of the Court, and have to disclose what they know...
Dr. Eliott, while not contesting this ruling, said bo was placed in a painful position
The Judge: I do not see any painful position abut it at all. You are bourd to observe the regulations not to disclose voluntarily the information that you obtain, but so far as giving information which you are bound to give in assist ing the administration of justice is con cerned, it is your duty to give it, and it is not a painful position at all.
Dr. Elliott: We do not undertake not to disclose voluntarily, but not to dis close at all.
The Judge: Then you be no power to do so.
Witness said it was one of the things they held dearest--the confidence between doctor and patient, and he hoped his Lordship would recognise their position.
The Judge: It is not an unfair obligation for doctors to assist in the administration of justice. You must give evidelice.
Dr. Elliott: Very well, I have nothing further to say, I must bow to your ruling, I presume, and give evidence. He then gave evidence na to the respondent's ailment.
