needed. This view of the matter com- mands general concurrence, Tho startling fact that a body of alien enemies may, as a so-called British corporation, invoke the the aid of the King in his Courts while the King's proclamation denies such privileges to them as alien enemies in their Individual capacity, reminds us of the public attention which was called a couple of years ago to the practics which had obtained in Hongkong of including in the register of British Companies cor porations entirely controlled by men who were not of British nationality. It would be interesting to know how many so-called British companies aro now on. tho Hongkong register which are controlled largely, if not entirely, by alien cuemics.

While this question is scarcely one that affects the Colony of Hongkong-since all

allen enemmies have cursed to be directers- of local companies-it apparently is not without some brazing on the position of those British Companies which have their head offices in the Treaty ports of China In one ..or two instances in Shanghai recently British share holders have forced the rotirement of alien enemy directora, but there must few so-called British be still not companies in Shanghai. rubber com panies particularly, in the control of which alien eneinies participate, and apparently there is no power, save that of the shareholders' vote, to oust them from the position. The law is something of a puzzle to the layan. We have in Hongkong an ordinance which makes the transfer of shares in companies, by, or on behalf of, an enemy a punishable offence, but "enemy" in this connection has been defined broadly as & person carrying on business or resident in enemy territory. China is not "enemy

But if the Company refuses to register the trausfer as many.companies, we under stand, have refused to do-it does not | seen that any means are open to an alien enemy to enforce what, in the present | circumstances, he might regard na his legal right. Matters would be much simplified if trading with the enemy by British subjects in China were definitely prohibited. The result of the considera- tion which Sir. TRADING WITH THE ENEMY. It seems a curious anomaly that bodies of aljen enemies incorporated as British companies should still be allowed to exist in England. Ono such company has re cently had the audacity to come into the British Courts under its corporate name -to-prosecuto a claim and it won the

action.

This incident has recalled atten- tien to what Lord WRENDERY in letter to The Times calls "a legal qucation of the first importance at the present time,” namely: Can a body of alien cuemies by incorporating themselves as a. British INVEST-corperation come into the British Courts ander that corporate name and claim to Bet? He quotes Lord LINDLEY, the great est living authority upon this branch of the law, as saying: Is company duly incorporated is in fact under the control
