On November 26th Mr. Pooley met with Mesara. Herrmann and Wilhelm at the Yokohama offices of the Hongkong and Shanghai Banking Corporation, and in the presence of the manager of the bank the documents were returned to the repre- sentatives of Siemens-Schuckert, To cover expenses incurred by Mr. Pooley and Router's Telegram Company, and also bush money to those concerned, Mr. Herrmann paid Y.25,000 On this occa sion, Mr. Herrmann paid another Y.25,000 to Mr. Pooley personally in appreciation of the goodwill shown and the efforte exerted by him in restoring the documents

The statement concludes by pointing out that there was no blackmailing committed, and that Mr. Pooley only demanded that the Japanese naval authorities should replace dishonest officers by honest men The defendant also maintains that Mrs. Pooley has had nothing to do with the matter.

The defendant contends that the case arises out of political struggles here and that he was victimized, partly owing to misunderstanding of the public as to the real circumstances of the case. Accord ing to this statement, Cari Richter visited Mr. Pooley for the first time on November 3rd, 1013, and produced papers containing facts, which if published would disclose corruption in the Japanese navy. Three documents were offered, for sale to be used as material in Mr. Pooley's journalistic work. The defendant agreed to peruse the papers, and the same afternoon called apon Richter who was staying at the Hibiya Hotel. Mr. Pooley found that the papers contained useful information for his prass work, and as Richter asked him to buy, the defendant agreed to consult with Mr. G. Blundell, the then agent of Renter's Telegram Co. After consulta tion with Reuter's agent, it was decided that the papers might be purchased at a price not exceeding Y.760.
