MAN'S RELATIONS WITH WIFE'S SISTER:
PROSECUTION IN SCOTLAND.
Counsel for the Crown appealed to a Scottish Act of Parliament of 1667, which was based on. Leviticus XVIII. Counsel said that in case decided by three Souttish Judges in 1856 such intercourse was held to be incest. No prosecution had occurred of the same kind for two centuries.
Counsel for the accused contended that even if it were expressly forbidden by the old Scottish Act in cased to be incest when the Decoused Wife's Sister Act, 1907, was passed to legaliza marriage with deceased wife's, sister. The law had thus put the wife's sister on with the forbid- deu degrees.
The Lord Justice General (Lord Strath- clyde) said that in his judgment the in- dictment disclosed no crime according to the law of Scotland. The question do pended. exclusively upon the just construction of the old Scots Act of 1897. That Act condemned to death any who committed offences expressly forbidden by Leviticus. The Act was constructed on the Geneva version of the Bible, published in 1560. He had examined the verge pointed out by the Crown in support of the indictment,

In the book I covered when the husband-went to register published in 1910 on the history of that the birth speculation, cintly described, in the concluding chapter, how the winding up of companies was carried on and how large bankruptcies and insolvencies had to be dealt with Of course, there can be no maimer of comparison of the magnitude of that process of liquidation with the one wo are now witnessing, Some 127 companies with 75 crores of liabilities had to be wound up of which 54 were purely banking and financial corporations, many with fantastic uamos which for curiosity sake may be rond in the list given in the fourth chapter of the said book. Apart from those, there wore as many as új farge bankruptcies, involving over a hundred persons, the Jiabilities of which ranged from five lakhs as the minimum to a maximum of three Crores. And as to ordinary insolvencies under fire lakhs they were a legion, Foreseeing the deluge of the insolvencies of large bankrupts which then threatened Bombay and which it was impossible that the official assignee could cope with, Sir Battle Frere, then Governor of Bombay, took time by the forelock and passed an Act which is known as Act 25 of 1805, Mine objeel of which was to live aft heavy bankruptcies liquidated by Trustees but under strict supervision of the Court, The boneal of that legislation was only allowed in cases where the liabilities The Act itself was limited in its operation to two years. Thus an efficient machinery for speedy liquidation was devised. On the whole worked well, though, it is rueful to say. it gave birth to a tribe of some corrupt trustees. The tribe of the liquidators was worNC. In reality the majority of them were blackmailers and feathered their ob nests. Indeed they made money out of the wreckage of the banks atud Snancial, institutions thes were entrusted to wind up. I might, write quilo a volume on the subject of the scores of ways in which the liquidators of such concerns enriched themselves. One such who was both liquidator of
any companies and a trustee of dozens of burdkrupt estates, was brought before the bar of the High Court. He was only uble to save himself by the skin of his Many director and manager teeth.

He regarded the verse
as clear, plain, and explicit, recognising not encouraging, not permitting, but recognising-polygamy. It prohibited the polygamist to take two sisters to wife at the same time. The reason given was the production of jealousy or envy in the Lousehold. According to Bibles published in 1571 and 1559 the marginal note re- ferred to the 20th chapter of Genesis, in which they found the account of the unhappy matrimonial
domestic and. relations of Jacob with his two wives Leah and Rachel. The facts set forth in the indictment did not to day, and nover- in any time did, constitute a crime accord ing to the law of Scotland. Therefore, he beld that the indictment was irrelevant, and that the accused should be released.
Lord Johuston was the only disentient Judge.
