Probably no judgment given of recent years has contained more interesting mattor for marine
underwriters than that of the House of Lords
in the case of the Gunfort. The hearing was an appeal from a decision of the Court of
Bession, Scotland, which at the time sroused a good deal of comment, because it was claimol that the decision, if upheld, would prove pre-

Briedy, the slip Gunford was wrecked on the Brazilian coast in 1907, while bound from Hamburg to Santa Rosalia, and as the result of a Board of Trade inquiry the master's sertifi cate was suspended for twelve months, and the Court considered that the insurances were excessive. A large proportion of the under writers denied liability, and ploaded inter alia that there was concealment by the assured of the following material facts-namely, that captain had heen appointed who had not been to sea for 22 years and had had his certifionte suspended for six months for losing his last ship; that the ship consequently was unsen- worthy; and that in addition teinsoring a vessel not worth £10,000 for the sum of £13,500, the amenrod had effected honour or disbursement

CONCEALMENT OF EXCESSIVE INJURANCE,
At first sight underwriters may fool little surprised at some of the arguments. delivered. They won neither on the question of concealment of material facts as to the captain, nor on the question of unseaworthiness, but they did win on the point of concealment of excessive insurance. It was sisted that the actual value of the. hall was £9,000, and that the freight to be earned was about £5,000, of which half had been paid in advance and was not at risk, so that it was easy to account for £11,500. The instiranco effected on the hall mounted to £19,000, but it should be noted that underwriters accepted this valuation with their ayes open, and therefore would ecarcely expect sympathy if they had to par sway this amount in a total loss claim. In adition £5,500 was effected on freight, though to only less than half that amonat appears bave been at risk; £4,600 was placed on "disbursements;" another £6,500 was effectad by the managor: and on the master's effects £200, bringing the total insuraucos ap to £35,803 The insurances on disbursements were +fected P. P.L.,
that is to say, without further proof of interest than the policy itself."
Hitherto it has not been customary for brokers to disclose to underwriters on hull the total amount effected F.PL, but the moral of the present judgment seems to be that where the insurances so effected are excessive disclosure must be made. There has been a crop intely of Beard of Trade inquiries, and in several of them the Coart has referred in revore language to over-insurance; in. some casos anderwriters no doubt were aware that the values on the hall were exccasiye and took the risk, charging a bigh premiam which they deemed sufficient to cover all con fingencies. It is of course, greatly to the later t of underwriters that owners should not be placed in the anomalous position of standing to guin
by the loss of a vessel, and the judgment showing that concealment of excessiva inaurence does vitiate a

Tho Thackeray Centenary roused Calcutta to the pride of possession, and the Thackeray Din ner.
