IMPORTANT SHIPPING APPEAL.

MOUSE OF LORDS DECISION,

The House of Lords delivored judgment last mouth in the appeal case-Owners of cargo of the steamship Tongariro t. Astral Shipping Co. (Ltd.)-which raised the important point to cargo owners, whether in case of a collision, în which both vessels were to blame, the owners of cargo punid obtain damages from the owners of the other vessel, in full or to the extent of a moiety only. The onse was argued last monthi before the Lord Chancelier and Lords Halsbury, Atkinson, and Shaw, when reliance was pincad by the respondents apon on old Admiralty Rale, which was to the affect that in such circumstances oach vo sel was to be hall liable for the moiety of damages resulting. The cargo owners, how- ovor, submitted thať addis rule was bad in law. and should not be sustainal, even though it had oxisted since 1789.

It was an appeal by the cargo owners from a judgment of the Court of Appeal, which uphold

The Lord Chancellor, in delivering judgment, first proceeded to review the circumstancos of the notion which led up to the appeal. Procoe ing, he said he had first to seo what was the rule of common law. Originally that was to the effect that nothing could be recovered at all in such a case as this, as there would be difficulty 1 as to identification. It was not good in prin. ciple or good sonso, and was exploded by a former decision of that House. The Admiralty order, which it was scntended applied here, w to the effect that shipowners, in case of collision in which urch vessol was to blame, could recover one-half damages only. The question for decision was a very simple one, and it was this: Was there an Admiralty rule, which was in force, and which had regularly been applied. Clearly there was, and clearly also it over-rode the common law rulo. He should be glad if he could award this appollant full damages, but he had no choics under the Admiralty rule, which was in force.

Font Halsbury followed and said the whole case bad to be decided on the meaning of the Jurisdiction. Act, 1873, and they must give affect to the enactment. The Court of Admiralty ad- ministered a different system of jurisprudence, and he felt that he must abide by what was called the rate of Admiralty, that was the rale of the Lord High Admim. It was a different system of jurisprudence to that of the law of England. There was a difference in law, not merely in the practice of the Court, bat a difference in the law itself. There was not the same source of law in the Admiralty Division A# the, souron · of common law. It was for that House to lay down what was the existing law, and not to alter the law. The rule of the All- miralty was laid down, and they had to ascertain what it was, and apply it to this case.

Lord Atkinson said thoir lordships had not to alter the law, bat only to find out what it was and apply it. This rule of the Admiralty mast be held to have been in foreo, and to over-ride any rule of comerion law,

Lord Shaw concurred, and the appeal yog accordin dy dismissed, with costa.

This decision is against the carge owners.
