SEAMEN'S WAGES.

An appeal to the House of Lords from a decision of the Court of Appeal which reversed the decision of Mr. Justice Bargrave Deana was decided on July 29th. The question was whether the respondent Baxter (the Board of Trade being appallante, though they were in reality supporting Baxter's claim) was entitled to his discharge from the Ecarsdale, in which be serving 期望 fireman, on her arrival at Southampton, where her cargo was discharged, or was bound at the captain's order to go on to Cardi-The latter contention was supported the Court of Appeal. Tho deal of the Board of Trade argued that. whilst the vessel might load at several different foreign ports, it could not, after delivery of n cargo withia boms trade limits, continue the voyage. But I see nothing in the agreemat to apport this contention. It seems strained and artificial, and cannot be supported unless, as Sir Fiules alaltied, words by implication I gather that this were read into the articles:

admission was made from the judgment of Lord Justion Fletcher Moulton. I cannot see any hardship or injustion that ein arits from accepting the agreement in its natural" sonte. It was urged that if the respondent's view were correct, a series of voyages might be undertaken whilst only one

Chancellor My Lords,--The question in this osae is whether or not Charles: Baxter, a fireman who served in the steamship Scarsdale, is entitled to the sum of 1.3.19 being the balance of wages, and also a sum of for sompausstion. A summons was taken ont under section 184 of the Merchant Shipping Act. 1891. The magistrates found the facts and referred the case to the Admiralty Court under section 165, subsection 3, of the Merchant Ship ping Act, 1896 Baxter claimed his discharge at Sonthampton when the Scarsdale arrived there on September 28, 1914) He was engaged on the following terms:That he way to serve on a voyage not excaucting one year's duration to any ports or places within the limits of degrees north latitude and 60 degrees south latitude, commencing at Cardiff, proceeding thence to Malta, bereafter trading to ports in any rotation and to end at such port in the United

Cutinout of Europe (within houe Kingdom or trading limits) as

be required by the trading inaster." The Scarsdale proceeded to Malta, thence to the Black Sea where she took in grain,

and thenes to Southampton, where the arrived on September . The ship thereJapan. discharged the whole of ker ergo, and Barter claimed his discharge, The master of the Scarsdale zult him he would have to go on to Cardiff. He said nothing further, and it is obviously consistent with the master's attitude at the time, as it is with the argament urged before your Lordships, that the real claim on behalf of the shipowners was that Baxter should serve iu nsuccession of voyages, aut exceding in all one year's duration, until the master should think it to fix upon a particular port

The There is an indication and -no more. Legislature apparantly attaches importance to the arrival of a ship at her port of destination: in the United Kingdom, and the discharge of her cargo there. It must in each ouse by n question of fact what is a voyage, and in ascertaining what it is a Court may regard the. following among other considerations: The duration of the adventure in point of time, and its unity, its geographical limits and. dire dion; whether new cargoes are shipped. or new charters male, or ports visited in orde ig sucession, and in particular whether there has bean a sailing from and afterwards a return to the United Kingdom. Coming back to the United Kingdom, in the case of a British ship. is not quite the same thing as returning to another port. It is in the nature of a haute- coming, and where followed by a completa dis charge of cargo it does in a considerable degree denots the termination of a voyage. If, looking at what is due as a matter of business, that urt pernaives that thera is a series of Beveral adventures autot ens adventuro divided in several stages, then it is not one royage, but two or mere voyages and the agreement must be a ranting agreement with it limitations of time attached. It is not lawful to escape the limitations attaching to a rating agreement by calling something a voyage which in priat of fact is not a single voyage.
