Mr. Slade said that was not so. The Charter Party must be taken as a whole. The ship owners were only bound to carry all goods whether way was derintod or not, if they did not come under the heading of conzrahutid.

Mr. Slade resuming his defence said that this was not an agreement in carry, contraband. If the ship rau the risk of seizure by our of the belligerents, whether such seizure was legal or legal, the ship run the risk of "Restraint of

His Lordship said he was inclined to think the ship, under the circumstances, agreed to run the risk. The agreement was not to be cancelled if war was de lured; the ship must proceed with her cargo just the same. That is why the clause was put in.
Mr. Slade said thas one clause modified another. In the Charter Party it was agreed that the ship shonld íún no risks.

His Lordship-They could come down on the ship, though the charterers t ok the freight?
Mr Slade-Yes.
Is Lordship took a note of Mr Slude's contention
Mr Slude said that at the time Russia had a strong naval foren, including any fast cruisers in the East. Russian warships and Prize Court, would be governed by Russian regulations. What did the ship-ownor know about Interna tional Law? What was of more tiste importance to him was how to protect him- self against the Russians. It was customary for ship-owners to insura their ships. There asual clause in the policies, freeing the insurance companies from risk of capture. If they were to run the risk of seizure, the object of insuran-e would be avoided.
W
His Lordship-You quan to say that if the ship had been captared the insurance would be risken?
Mr Blade-Yes.
His Lordship- I do not think that at the time of signing the Charter Party, it was in the minds of the parties that fo. Istuffs were con traband.
M. Slade-I will refer Your Lovilship to a
letter from the Charters dated the 20th February, for the From theus leit Hengkong on her first voyage. In this they asked the agents to discharge the captain because he they were contraband. This was only ten days objected to rise and sugar on the ground that after the signing of the Charter Party, and before the Russian Declaration regarding con- traband.
Hon. E. H. Sharp--And after the Insurance Companies had notified that they were contra- band.
Mr. Slade suid that there was no evidence of that, and even if there was, inasmuch that it

Mr. Blade-We have never wanted to draw out of the Chartor Party
His Lordship-You refused to carry goods, Mr. Blade-We only refused to curry con traband.
His Lordship-Well, you must take some risk. You know war was going to break out, Lnd agreed not to break the Charter Party, though you chartered the ship to one of the belligerents.
Mr. Blade said that this was simply un agreement not to discontinue the Charter Party in the event of hostilities. It was agreed.

His Lordship Did you not say something about more money?
Mr. PLAYFAIR, in seconding the motion, said that as far as he could ascertain from the Hon. Scerotary, the present position of the nurses Wae quite satisfactory. He did not think there was canse for, fríetion in any way. If there were any cause for friction between
