CAT files suit for

possession of planes

Civil Air Transport, Incorporated, has filed a suit against the managements of the China National Avia- tion Corporation and the Central Air Transport Cor- poration for possession of the assets of the airlines in the Colony, at present impounded by an order of The King, it was learned yesterday.

It is understood that this time the action is speci- fically for a Supreme Court declaration that CAT, Inc., are the owners of the aircraft and equipment, and aro sololy entitled to their possession,

CAT Inc. recently brought an appeal against the decision of the then Chief Justice, Sir Leslie Gibson, who some months ago refused their application for the appointment of a receiver in respect of the airlines' assets in Hong Kong,

The Court of Appeal upheld Sir Leslie's refusal of the application in that the doctrine of sovereign immunity operated over the airlines, and dismissed the appeal.

Major General Claire L. Chennault has announced through a spokesman that he is bringing the appeal in this connection before the Privy Council in London.
