TRAGEDY ON EMPRESS

Preliminary Trial of Filipino.

EUROPEAN EVIDENCE.

Graciano Bilas, the Filipino who is alleged to have ran amok' on board the C.P.S. R.M.S. Empress of Canada at sea just before reaching Yokohama, 31 persons being wound- ed (two fatally) as the result of the affray, made his appearance before Mr. Williams at the Central Magle- tracy yesterday afternoon when his preliminary trial was opened.

Mr. H. Somerset Fitzroy, Assis- tant Attorney General, appeared for the Crown. The accused was not legally represented and was not required to plead. As he under- stood very little English, Tagalog interpreter was present to explain the proceedings to him.

The outline of the case was given by Mr. Fitzroy who went into the detail as already published.. in the China Mail on the day of the arrival of the Empress, of Canada in port...

Evidence corroborating Coun- sel'a statement was given by Mr. Cecil Claxton, Chief Officer of the Empress liner, and when naked through the Interpreter if he had any question to put to the witness, Bilag went into a rambling state- ment regarding his job and his enemies.

Accused's Statement.

A statement made by the accused when charged with murder was put

in by Mr. Fitzroy. In this Bilas said:

"I don't remember about killing the Chinese, because my enemies are Japanese. The Japanese were threatening to throw me overboard so Filipo gave me the knife and I started to stab them ; all,"

The Public Prosecutor: He was thinking that all the Japanese were;

Doctor's Evidence. Dr. R. J. Patchett. ship's Bur geon,

said that in his opinion, Bilas 'was suffering from maniac depressive psychosis. He had ques- tioned Bilas in English and received answers in English which were not very rational.
