The facts alleged are that the plaintiffs entered into three con- tracts by which they sold various) quantities of gunny to the defen- dants, the International Export Company (in liquidation) but a dispute arose with regard to 325 bales
The plaintiffs who sold the goods to the Export Company pur chased them from the mills and the goods were placed on board the steamer belonging to the de fendants, the Nippon Yusen
Kaisha.
The plaintiffs' case against the steamship company was that they fraudulently issued to the Export Company bills of lading with a view to helping that company and to defrauding the plaintiffs. This was done after receipt of the notice of the plaintiffs' lien in the goods and without the Export Company's producing the mate's receipt, which was granted by the mills when they were paid by their buyers.
