DAMAGES

London-Quoting the judginents in the "Orita," the famous case involving the question of submerged wreek in the Mersey, Mr. Justice Wright in the Com- mercial Court found that the fiartle- pool Port and Harbour Commissioners failed in their duty to invitees and were liable for damages sustained by the steamer "Orient City," owned by the St. Just Steamship Co., Ltd., of Cardiff, which strack the hidden wreek, of the steamer "Burnhope."

The pilot of the "Orient City" said that when the wreck ceased to be buay. ed he was entitled to assume that it had caesed to be a menace.

Captain Henry Francis Defrates, in the course of his evidence, said he in the Thames swept with 100 fathoms of wire running on the bottom, and when the defendants used 15 fathoms of chain, it was not so satisfactory.

The proposals of the Harbour Board as recently outlined call for an expens diture of 669,000 dollars spread ever a period of years, this amount to be later stepped up to 2,000,000 dollars, At the present an expenditure of 100,000 dollara orly is contemplated in the development of 59 acres of land on the old western sand bar. immediately to the South of the Western Gap, to provide a base for seaplanes and am

The story of Tristan da Cunha natives of the far-off South Atlantic gives new details of the disappearance of the "Kobenhavn," the largest sailing vessel in the world. Its fate has been a mystery since reported missing with sixty cadets aboard. Captain H. Kristen

en, of the Danish motorship "Mexico," has been searching for the missing vessel and credits the natives' story with a great deal of truth. They say the "Kobenhavn" was seen, all salls furled and nouo on tourd, drifting in the currents of the Tristan de Cunha islands. Captain Kristensen is refuelling and continuing his search.

THE QUESTION OF NEW MOTORSHIP TONNAGE

He came to the conclusion that there was failure to exercise ressonable were and skill in identifying position of the wreck, and in effectively removing or dispersing it. The wreck was found after the "Orient City's" accident, and was then dispersed.

The position of harbour authorities to ships using their waters was clearly stated by Lord Phillimore in the cna nf the "Orita," and by. Lord Justice Serutton in the Court of Appeal. The Commissioners tos lightly formed the conclusion that the wreck had been dis persed, but it was the fact that ho other vessel than the "Orient City" ever found it. Their ignorance of the posi- tion was entirely unjustified, was his Lordship's conclusion, though it might well be that they innocently failed to discharge their duty to vessels coming
