In the trial of the case it was brought out that during the period named Mr. Andrews was absent. In the provinces and that he left the conduct of the business. in the hans of the cashier. Julian Rafaen trusted employe. Upon his return he found that the money which should have been

Two payments. of P500 each. were made by the firm on October. 18 and Decem ber 24, 1924, respectively. Since then no payments have been made.

The proofs to the contrary shows that the accused is not, nor has been, the agent of the Century Insur- ance Company, Ltd, nor has he had any participation in the receipt and disposition of the funds that gave rise to the pre- sentation of the complaint.
