IN PORT OR AT SEA?
CURIOUS POINT DECIDED AT
MELBOURNE.
There is a clause in the award of the Seamen's Union which stipu Jates that when a vessel arrived and Jeaves again on the same day, or within eight hours, the master may treat the ship as being at sen all day. Mr. Justice Powers was re- cently asked by the Union at Mel- bourne to interpret, this award, and to say that the master could not treat the ship as being at, sea- all day for one part of the crew and not at sea for another part,
Mr. Justice Powers, in a judg- mont, said that when the Poolta, ausmuian-owned vessel, was al Devonport, Tasmania, on June 30, 1922, the engineers, by mutual agreement, were given time lf. The captain of the "Poolta" claimed that as the vessel arrived one June 30, que was die to sail, again the same day, he was entitled 15 treat the vessel as being at sen all day. They crew was therefore! required to keep watch. The own.] era contended that the action of the ! chief engineer in allowing the men me off at their home port did nol and could not affect the captain's! decision to treat the ship as it set. The union held tht as the ment could only be allowed time off under the award if the vessel were in port she could not be al sen if any of the grow were allowed time of. He (Mr. Justice Powers hell that the chicl engineer had no power to interfere with the right of the master to treat the ship as being at
The action if the engineer, which was consented to by the men, did not sffect the question of the vessel being at sea or in port. In any new award be ruade, he did not think that the present clause work be continned, and if it were continued there would be some qualifications, no Lbe clause in its present form was absurd.

Hippos Quarrel.
To solve a London Zoo housing problem, two hippopotamuses were placed in the same cage recently a two-thirds grown male and a four-years-old female. There was some anxiety as to whether the male would attack the little female, who was only half his size. The fears were well-grounded, for he at once started to bully her. With all the pluck in the world, the baby turned round on her tormentor, open-moothed, and fairly chased him round the cage. The great coward made his peace with the little shrew, and some enjoyable mixed bathing in the pond cement ed their friendship. Your Kimono.
