His lordship said it would have bean a question for the jury to say whether, they considered them a libel or not.

Mr. Davies did not bring this action to make money, his only desire being to vindicate himself with regard to the inference being drawn that be had acted in any way that was in the slightrat degree dishunourable.

Mr. Justice Darling: I think that in this matter, if that is all that was de- sired, I do not see why it could not been obtained before the case Way brought into Court. I think Lady Markham bas been treate badly.

Mr. E. A. Mitchedd-Ian-s, K. Q, who was with Mr. Giveen, watching the proceedings on behalf of Mrs. 0,Hen, (Lady Markham) said he was present to the capacity of watching. Owing to the way the case had been conducted, certain points of difficulty and delicacy which might have arisen had been avoided, and Lady Markbam, through himself, had now nothing to say as tithe way in which the case had been conducted or as to the nettlement,

Mr. Justice Darling: That involves no decision whether there was a libel or not. If a conclusion like this is

satisfactory, it is a pity Lady Mark- ham's name was ever introduced into it, and if the plaintiff is content with so little, that he did not attempt to got it mora privately, I see no reaSON

to alter my view of the matter. I can quite understand that a con- clusion of this kind may be agreeable to the parties.

Mr. Hastings intimated that the parties were content with the arrange- ment, and a juror was accordingly -withdrawn upon the terms arranged.
