Mr. Douglas Hogg, R. C., and Mr. Clement M. Davies, appeared for Mr. Davies and the defendants were re presented by Mr. Patrick Hastings, K. C. and Sir Hugh Fraser.
The defendants denied the words published were of a defamatory chaincter or libellous.
Mr. Douglas Hogg said he would have to tell the jury acmething of what might have been B happy romance, but which turned out to have had a very end ending for his client. It was the story of a man who was attracted by a lady of great charm and of well known position and stand irg, whose hopes were destroyed almost at a moment's notice when the lady, after being engaged to him for some months, went away and married someone else.
The announcement of the engage- ment appeared in the Press, and what Mr. Davies was complaining of was not that announcement. What they

On 15th March abe called at Mr. Davies's house and from what then took place the plaintiff knew that there was an end of their association. On 16th March Lady Markham was married to Colonel O'Hea, and there was an announcement in the papers. There was a long article in the Evening Standard, in connection with which a writ had been issued by Mr. Davies.
The alleged libel complained of was contained in the Sunday Times on 22nd Mareb, and referred to the en. gagement of the plaintiff and Lady Markham in the following terms:
