SIX MONTHS STATUTE OF LIMITATION IN COLLISION ACTIONS, Something entirely novel in the Admiralty Court has just been pray ided by judgment of Mr. Justice Hill in a collision suit, brought by the -owners of the Norwegian steamer Norrona, sunk in collision with a battle-practice target, in tew of his Majesty's tug Danube II against whose navigator, Lieut. Harry Jew: iss, R.N.V. R., sued for damages for collision. Mr. Justice Hill held-in word that the collision was caused by the negligence of the tugmaster he was protected, and the action was statute barred by the Public Author Ines Protection Act, 1893 A decision was cited in which it was held that the Act protected, an army driver in a motor against whom an action was brought, after the lapse of six months. The navigation of the tug and Mr. Dunlop successfully showed the logic of applying this finding to the Navy.

Mr. D. Stephens, K.C., and Mr. H. C. Dumas (instructed by Messrs Constant and Constant, London) appeared for the plaintiff the Altern rey Generarl (Sir Gordon Hewart, K.C) and Mr. C. R. (instructed by the Treasury Solicitor) for the defendant,

Jewiss, R.N.VR, the defendaj was, in charge of Lieut. Harry he bad held to be whois Degligent. His Lordship confessed that the proposition for the defend- ant came to him as a startling one, because it was within the knowledge of the court that it was a defence which would be applied to any case of negligent navigation of King's ships where the action was brought against the navigating officer unless the action was brought within six months of the act complained of.

The collision took place at about 4 10 p.m. on 7th Dec, 1917, in the Thames Estuary, when the Norrona (246 tons-gross) was in the course of a voyage from Fecamp to Middles. brough, in ballast. The weather was Ane but a little hazy, and the Norrona, which had teen ordered to come to an anchor, as mine sweeping opera tions, were in progress to clear the chanuel, had brought up, and was riding securely to her ancher, with her head to the flood tide. No anchor lights were being exhibited in accordance with the orders of the authorities, but she had the blackball signal holated, and it was plainly visible. The Danube Ii, which was towing an unmanned barge or craft -with a very long scope of tow rope, was so negligently navigated by the defendant, so the plaintiffs alleged, that she towed the craft into collision with the Norrona the stem of the 'barge striking the starboard side of the Norrona uch a serions blow that she shortly afterwards sank. The plaintiffs alleged that the defendant had a bad lookout, improperly attempted to navigate the tow across the head of the Norrona and did not stop or reverse engines.

The defendant denied negligence, and stated that shortly before 4,10-Jo p.m. on 7th December 1918, he was in charge of the tag Danube II, which was towing a battle target from Portsmouth to Scapa Flow. The tug was proceeding in accord ance with orders to an anchorage in the Black Deep and was making about 3 knots through the water, a good lookout being kept. In these circumstances the target without any negligence on the part of the defen- dant took a sheer to port, and although the helm of the tug was put hard-aport and the engines full speed' abead the target struck, the Norrona on the starboard side.
