Mr. Rowan pleaded guilty" to possessión. but dealed attempt to export. He said his client had a very good excuse which he thought would satisfy his Worship.

The Magistrate decided to bear evidence.

A Chinese detective said he went on board the s.3. "On Lee " to search passengers" fuggage. On board the ship he met a friend whom he had not seen for a long time. In the course of conversation, he told his friend that he was on search duty, whereupon his friend said. "Do you know the steward? He is doing a lot of business, and making-pota of money. He is looking very fat and days. It would happy these be worth your while to search "his property." With this, witness. went to the dining room, of which the defendant was in charge, and asked for him, but was told that he had gone ashore. Witness went into the defendant's cabin, accompanied by one of the defendant's fokis. He searched several boxes which were open, but found nothing but clothing. After a while, witness came upon a rattan basket which was locked, He asked for the key, but, was told the defendant had taken it with him. Witness suggested that the defendant should be sent for, but was informed that he might be expected back at any moment. Whilst waiting for the defendant, witness went on with his search, and in a cupboard in the dining room, he found some bot ties of liquor and mineral waters, also another basket which was locked.. Witness:

the basket removed and closed the cupboard. After waiting about an hour, a European sergeant came, at about 6 p.m., and witness told him about the baskets, which had not yet been searched. He was ordered to take the baskets on to the Ho Tak wharf, and did so. At about 6,15, a few minutes before the ship sailed, another foki came and produced a key with which one of the baskets was opened. Witness sear ched this, but did not Énd any con- traband. The defendant. turned up just then, and witness got him to open the remaining basket. Under some clothing, witness found several rolls of money. Witness was about to break open one of them when the defendant told him they were Chinese 10 cent. pieces. The defendant'

broke one of the rolls in the middle and exhibited a couple of "Dragon" 10-cent pieces. Suspect- ing that the defendant was trying to bluff, witness inspected the other money and found nearly half of the 'roll was composed of Hongkong 10-

cent pieces: It was the same with.... the other rolls which witness subse- quently inspected. He arrested the defendant.

pieces, not done up in rolls; but

wrapped up in paper.

Mr. Rowan submitted that as steward of the ship, the defendant needed some small money for to give change to passengers. He submitt ed that there was no proof that the defendant was exporting the money for any other purpose. The defendant had often, when he had too much small coins, brought them to Hong- kong and changed them into notes.

His Worship said that too many small silver coins were being taken away from the Colony lately, and this practice must be discouraged. A fing of $25 was imposed, and the silver was ordered to be changed

into notes.
