Before Mr. Justice Voules in Kuala Lumpur Supreme Court staten" the "Malay Mail, Messrs. Cumberbatch

and Cot sued Mr. H. Lesser, an ex- member of their staff, for the sum of $1,395,65.

Mr. J. T. G. Pooley, who appeared for plaintifs, sald defendant left the employ of Messrs. Cumberbatch and Co. on May 3 without having given riotice, and went to work for a firm in Singapore, who had apparently offered him a higher salary. He had failed to return $125 that he had | korrowed from the cashler, he had not paid forbils board and lodging at the Chambers, and he also owed a small Bum to the Selangor Turf Club for latteries. Masers. Cumberbatch-and Co. had paid those bills and were DOW making a claim for the motley, 'Almost as soon as proceedings weźe Instituted, defendant left Singapore for Shanghal, but the suturons had been served on him there.· ́`·Mr. Leser had instructed Messrs. Rogers and Son and they had sent kimw statement of defence, but he had not teturned it, and counsel understood that there was no defence.

Mr. G E Tesle, local director of Messrs. Cumberbatch and Co., wala. defendant was employed by the firms. at a salary of $350 per month. He left on May 3 without giving notice, he had overdrawn to the extent of $125, and owed the Turf Club $100, which the firm had been called upon to pay.

RULES OF THE CLUB

Mr. Pooley said. the rules of the Club provided tirat, in cases of this kind, the proposer anti rekonder were liable. He supposed one should be very cautious before proposing Thy-" -one as a member of such a tlub.

His Lordship"was-of-the" opinion that the money owed to the Turf: Club was a' gambling, debt," and "it' this part of the cland was therefore, agreed "to" withdraw

His Lordship wished to know why" plaintiffs paid defendant's debt at the Chambers.

Mr. Teale replied that defendant could only obtain admission to the Chambers by being a member of the Selangor Club. He had been pro posed as a member by a director of the firm, and the debt had been paid at the request of the Club.

Mr. Pooley said the firm could not be sued for the money, but they were liable, although he thought that the rules of the Selangor Club were somewhat different from those of the Turf Club. Defendant hád - them '$75- and another cheque for $70 which they were unable to cash. The money was not paid to the Club at defendant's request, but he thought the firm were liable, if merely for their own good name.

His Lordship said if the proposer was liable,, he would never.propoke anybody as a member, If a man became a permanent member, the proposer was not liable at any time for his debts..

Mr. Pooley contended that plain. tiffs were entitled to have the money ́refunded, by defendant for: whose.
