I would be doing violence to ely that these words amount to a refusal, much less a wrongful refusal, to carry the goods. The shipper may, if he disputes the officer's opinion prove the contrary,

notwithstanding the terms of the officer's receipt. The contents of the receipt are not so binding on the shipper as to stop him from impeaching their correctness, especially when he can place hinfself in a similarly advantageous position by making

protest ustry on the receipt.

Flis Lordship therefore finds thore was no wrongial refusal to carry the packages in the part of the defendant Company, and that it was entirely due to the misguided and incunsiderate action of the plaintiffs' gents who were in board this steamer that the goods were not carried. His Lordship is inclined to think that the actual fiets were misrepresented er disclosed by their tally clerk to the plaintifs. The plaintiff action is dismissed with costs.--- Pines, Ceylon.
