a seamstress is workınan within the mean- ing of the Employers' Liability Act was discussed in an appeal from the Bloomsbury County court. His Honour Judge Bacon hnd decided in the negative in an notion brought by a Miss Maynard, employed at the establishment of Peter Robinson
(Litnite), and given judgment for defen
dants, notwithstanding the fact that the
jury had found in favour of plaintiff, and
awarded her £25, damages. The learned judge not only expressed the opinion that Miss Maynard did not come within the. Act, but held that there was no evidence as to how the accident happened.
Mr Ball argued that plaintiff was includ- ed in the class of employès entitled to the benefit of the Act. The class did not com- prise domestic or menial servants, but only applied to labourers, servants in husban dry, journeymon, artificers, handicrafts- men, or others engaged in manual labour.' Counsel submitted that his client was an artificor. Sho was engaged to work a se- wing machine, and to iron the seams which it made in the manufacture of ladies

Mr McCall, K.CA on the other hand, contended that the dress could only have boen burned by the iron which plaintiff was handling, and there was no allegation as to that. Counsel negligence in regard to further submitted that the young lady was not engaged in manual labour within the Act, because the phrase did not necessarily mean to work with the hands.
The Lord Chief Justice thought the
learned judge went beyond what he ought
to have done in saying that there was no evidence to go to the jury as to how the accident happened, and so far as that was concorned there ought to be an order for a new trial. The question as to whether the plaintff came within the Act was one of some difficulty. In the popular sense he doubted whether it could be said that plaintiff was engaged in manual labour, but it was clear that skilled labour was Dot excluded by the statute, It was not, howover, without some feeling of doubt that he came to the conclusion that plaintiff was engaged in manual labour, although in skilled manual labour. Although she did not act by the strength of her hands, he was of opinion that she was engaged in manual labour within the principle of some of the authorities, and was therefore entitled to suc.
The other judges concurred, and a now trial was ordered.
Leave to appeal was granted on the point as to whether plaintiff came within
the Aut or not.
