AN APOLOGY.

THE Ghana Mail owes Senhor fforts an Apology. In its report of his recent evidence, it accidentally omitted a por tion which has a somewhat direct bear- ing on ono important fact in the action, Regina v. Saint. That omission it will. presently proceed to supply; but a little matter of detail is necessary in order that. the public anay appreciato the nature of our fault, and that must be prefaced by an explanation which is forced upon as by the extraordinary character of the proceedings that have been instituted against the defendant.

Some folks of tender but uneven con soiances may blame us for making these li bol notions tlie subject of discussion in our columns. Under ordinary circumstances their objection would be good. For in atance, in the private notion which the Rev, Blr Lobscheid instituted against the Chine Mail in 1866, for alleged libel on bim in his capacity as coolic agent, it would have been highly improper on our part to have referred to the ass as an indirect interest in it, inasmuch ne parties thereto, for the public had only

the matter was between individuals.

But it is quite a different affair in

·Regina e. Saint Her Majesty, a therefore all her subjects, are the

prose- cutora, on behalf of another Monarch and all his subjects. It is avowed by the prosecution that no private injury has been done by the alleged libels; that the damage, if any, affects only collectivo reputation and character; that the funds for defraying the costs of the prosecution come out of a public exchegner; and that

all respects the China Mail is pursuel for alleged publio, and not for private, libels. For all of which reasons the de- fendant, fighting at long odds, claims the liberty of descarting as freely as he chooses on the case as it is disclosed against him, and hence he is induced to approach Sonhor Horta with an Apology. Aud now for the little matter of detail, which will lead to a better understanding of the nature of the Apology.

The prisoners charged at Macao with complicity in the Amanita piracy and murder caso were found guilty, but the verdict appears to have been appealed against, and (under the Portuguese law) a request made to the home government for the appointment of a judge substitute to re-hear the case. Sezhar Horia swore that the prisoners, did not apply for a judge substitute, but Senhor Horta did, - is the following official document testifies; and that he did so showed great con- sideration on behalf of the accused, who had been found guilty:--
