(2) with intent to deceive or defraud any member, share- holder, or creditor of the corporation or public company, whether any particular person or not;

is guilty of felony.

236.-Clerk or Servant falsifying Account.

Any person who, being employed or acting as a clerk or servant, with intent to defraud,

(1) conceals, destroys, alters, mutilates, or falsifies, or concurs in so dealing with, any book, document, valuable security or account, which belongs to, or is in the possession of his employer, or has been received by him for and on behalf of his employer; or

(2) makes or concurs in making any false entry in, or omits or alters or concurs in omitting or altering any material particular from, or in, any such book, document, valuable security, or account

is guilty of misdemeanour.

237.—Public Officer making false Statement or Return.

Any person entrusted with the receipt, custody, or manage ment of any part of the public revenues, who knowingly furnishes any false statement or return of any sum of money collected by him or entrusted to his care, or of any balance of money in his hands or under his control, is guilty of a mis- demeanour.

238.--Conspiracy to Defraud.

Any person who conspires with any other person by fraudu- lent means

(1) to defraud the public; or

(2) to affect the public price of anything publicly sold; or

(3) to defraud any person, whether any particular

person or not,

is guilty of a misdemeanour.

239.—Cheating.

Any person who, by a fraudulent practice calculated to defraud and cheat any considerable number of persons or bodies of persons separately, induces any other person to deliver to anyone anything capable of being stolen is guilty of a mis demeanour. He is also guilty of a simple offence if the value of the thing delivered does not exceed £5.

240.-Concealing Deeds and Incumbrances.

Any person who, being a seller or mortgagor of any property, or being the solicitor or agent of any such seller or mortgagor, in order to induce the purchaser or mortgagee to accept the title offered or produced to him, and with intent to defraud—
