behalf of this Government.

2. In compliance with the request contained in the second paragraph of

your circular of the 16th of May, I enclose copies of the local laws now in force relative to the matters dealt with in the Convention together with the statistical information A note specified in Article 21 in respect of the five years ended December, 1911. has been made of the request that, as soon as possible after the 31st December of each year, statistics for the preceding twelve months and copies of any laws, proclama- tions, &c., issued within that period should be transmitted.

3. I am advised by the Procureur-General that legislation here will be necessary to render effective the measures decided upon in the Convention, and inasmuch as similar legislation will probably be necessary in England I would ask that I may be supplied with the text of any Act of Parliament on the subject which would serve as a fitting model for local enactments in the Colonies.

ORDINANCE NO. 2 of 1867, to legalize the importation and sale of Opium on payment of certain Customs and Licence Duties.

1. It shall be lawful to import opium, either crude or prepared in any way. Duty shall not be leviable on opium, or its preparations or compounds, imported by druggists or chemists, provided that the druggist or chemist so importing the same, shall declare that it is imported exclusively for sale by him as medicine, and that any chemist using and selling the same for any other purpose shall be liable to a fine not exceeding Rs. 500, with forfeiture of all the opium, preparations and compounds of opium, in his premises at the time.

4. All persons (except as hereinafter provided) who shall retail opium crude, prepared, or refined, or any preparation or compound thereof, respectively, shall be bound to take out a licence in addition to any other licence duty payable by such persons.

This provision shall not apply to chemists or druggists selling opium, or any of its preparations or compounds, for the purpose of being used exclusively as medicine.

2. Section (v) The sale of opium in any quantity of one kilogram or less shall be held to be sale by retail; and in any quantity exceeding one kilogram, as sale by wholesale.

96. If any trader possess on the premises for which his licence is granted any 1993, Article article which he is not authorised to sell, and such person, on a complaint in respect thereof to any magistrate, be unable to account for the possession of such article to the satisfaction of the magistrate, such person shall forfeit such article and any vessels containing the same, and shall besides be liable to a penalty not exceeding Rs. 100.

I HAVE the honour to acknowledge the receipt of your despatch, No. 315, of the 9th July,* in which you transmitted copies of correspondence with His Highness the Rajah of Sarawak on the subject of the International Opium Convention,

2. You should represent to His Highness that it is the earnest desire of His Majesty's Government that he will assist their efforts to give effect to the recom- mendations of the International Opium Conference, and that if the trade in opium is left unrestricted in Sarawak the difficulty of suppressing it in North Borneo and Brunei will be greatly increased. You should accordingly urge him to come into line with all other civilised Governments, and agree to the signature of the Con- vention on behalf of Sarawak.
