A.

service is, whether before or after the com- mencement of the Ordinance, appointed to an office in the service of the Colony and subsequently, retires in circumstances in which he may be granted a pension, the Governor in Council may either

(a) award him a separate pension in respect of the latter period of servico, notwithstanding that the length of this period may not by itself be sufficient. to qualify him for a pension under Regulation 1, or,

(b) with the approval of the Sec- retary of State,

award him a pension computed as if the periods of service had been continuous,]

22. Where an officer who has been trans- transferred ferred from the service of the Colony to sionable to other public service which is not pensionable ultimately retires at an age at which and in circumstances in which he would have been permitted to retire on pension if he had con- tinued in the service of the Colony, he may, with the approval of the Secretary of State, be granted the same pension from the Colony as he would have received if he had retire! on the ground of ill-health at the date of such transfer, calculated, as the case may be, in accordance with Regulation 1 (if his service in the Colony had not been preceded by other public service) or Regulation 17 (if it had been preceded by other public service).

Provided always that if such an officer's service in the Colony is not of itself sufficient to qualify him for a pension it shall never- theless be lawful to grant him a pension instead of a gratuity in respect of his service in the Colony.
