We are honoured with your Lordship's commands, signified in Mr. Herbert's

Temple, June 11, 1873. letter of the 9th instant, stating that he was directed by your Lordship to transmit to us the enclosed copy of a Despatch from the Governor of Gibraltar relating to a petition for release from Lorenzo Martos, a native of Spain, lately sentenced in Gibraltar to be imprisoned and kept to hard labour in the Convict Prison for the period of three years, for receiving stolen goods, well knowing the same to have been stolen. Lordship desired him to request us to take the Despatch and its enclosures into con- That your sideration, and that we would favour your Lordship with our opinion-

1st. Whether Miciano was admissible as a witness on behalf of Martos, and

2nd. Whether, if we considered the evidence was admissible, the circumstances of the case were such as to justify the pardon of Martos or the partial remission of the sentence imposed upon him.

In obedience to your Lordship's commands we have the honour to

1. We are of opinion that Miciano was admissible as a witness on behalf of Martos. 2. We are unable to form any opinion as to what effect the evidence of Miciano ought to have produced, and consequently we cannot say that Martos ought to have been convicted, and we therefore think that the circumstances of the case justify the pardon of Martos.
