Doctor's Commons, April 26, 1861.
I AM honoured with your Grace's commands, signified in Sir Frederic Rogers' letter of the 8th April instant, stating that he was directed to transmit to me the copy of an Aot of the Legislature of Tasmania No. 1 of 24 Vict. " to vest in the Supreme "Court jurisdiction in respect of divorce and matrimonial causes.”
Sir Frederic Rogers was also pleased to enclose a report upon the enactment which was furnished to the Governor by the local Attorney General, and to request that I would inform your Grace whether I see any reason why this Act should not be left to its operation.
In obedience to your Lordship's commands I have taken this Act into consideration, and have the honour to

That I see no sufficient reason why this Act should not be left to its operation. The attention of the Colonial authorities should be called to the Imperial Statute 23 & 24 Vict. c. 144., and to the expediency of making some sufficient provision for checking collusive proceedings, and for enabling the Supreme Court to have important legal questions fully argued before it, for its own satisfaction, in cases where the litigants do not raise or argue such questions by counsel.
