Opinion on the Question whether arms condemned in a Vice-Admiralty Court must necessarily be sold by public auction.

THE whole property if condemned vests in the Crown and the Crown may dispose of it in any manner it thinks fit. It may sell the ship and retain the arms, or retain them both. But what it should do is to have the whole of the property valued for the If the court purpose of guiding it hereafter in granting a reward to the seisors. condemns it, it condemns it to the Crown, and it remains with the Queen's Proctor (or Advocate) to decide whether it will apply to the Court for a further decree ordering it to be sold.

If the adverse party apply for the sale it should be opposed by the Crown, and in that case I feel quite certain that the Court would never make the order..
