We are honoured with your commands, signified in Sir Frederic Rogers' letter of the 17th ultimo, stating that he was directed by you to transmit to us a copy of a Despatch from the Governor of the Cape of Good Hope, forwarding a memorial No. 34, addressed to the Field Marshal Commanding-in-Chief by William Sandys, a convict 23 Apr.1866. under sentence of a court-martial, with papers relating to the case, a copy of a letter W.O.,9 Aug. from the War Office, with its enclosure, on the subject, and a copy of Governor's Com- mission, the 8th clause of which conveys the power of pardoning offenders, and to Clause 8 of request that we would inform you whether the Governor has power under that clause Governor's to pardon soldiers sentenced by court-martial.
In obedience to your commands, we have taken these papers into consideration, and have the honour to

That we are of opinion that the Governor (who is also Commander-in-Chief within the Colony) has the power, under the 8th clause of his Commission, of pardoning soldiers sentenced by courts-martial within the Colony.
