I AM of opinion that if the Legislature of St. Vincent were to pass with a suspending clause a law repealing No. 602, and re-enacting it with the amendment proposed to be made by No. 805, it would be competent to Her Majesty, after assenting to the repealing law, to found upon it a second Order in Council suspending as to St. Vincent the prohibitions contained in the Imperial Copyright Law; but I am of opinion that this course is not necessary, and that it will be sufficient if Her Majesty assent to Act No. 805 in its present form, and thereupon make a second Order in Council founded on that Act.
Upon the Act No. 805 coming into operation in St. Vincent, it will have the effect of annulling the suspension of the prohibition of the Copyright Acts now existing by virtue of the Order in Council of the 18th August 1852, but a new law (namely, the combined Copyright Acts, 1852 and 1864) having the same objects as the old will, at the same time, come into force.
I think that the power of Her Majesty under 10 & 11 Vict. c. 95. is not exhausted by the approval of one Act and the issuing of one Order in Council, but that as often as an Act is passed by the Legislature of a British possession, whereby due provision is made for the protection of British authors there, Her Majesty may issue a fresh Order in Council. If, then, it appear to Her Majesty that the Act No. 805, altering, as it does, the Act No. 602, is sufficient for the purpose of securing to British authors reasonable protection in St. Vincent, it is, in my opinion, competent to Her Majesty, after assenting to No. 805, to found upon it a second Order in Council suspending as to St. Vincent the prohibitions contained in the Imperial Copyright Law, and I have accordingly drawn such an Order.
