(SOUTH AUSTRALIA.)
LAW OFFICERS to COLONIAL OFFICE.
Temple, July 14, 1863.
MY LORD DUKE,
We are honoured with your Grace's commands, signified in Sir Frederic Rogers' letter of the 23rd June, ultimo, stating that he was directed by your Grace to acknow- ledge the receipt of our opinion on the validity of a certain South Australian Act conveyed in our letter of the 13th May.*
Sir Frederic Rogers was also pleased to add that we stated our opinion that an Act should be passed at once confirmatory of all Acts passed by the two houses, and that the legislative powers of Colonial Assemblies for the future should be clearly defined.
That the general definition of the powers of Colonial Assemblies is in itself a matter of so much importance, and is connected with so many other important questions, that your Grace thought it would be best dealt with in a Bill of a general kind which it is his intention to submit to Parliament during its next session.
Sir Frederic Rogers was further pleased to add that your Grace would be glad to know whether the Bill, of which a draft is enclosed, is calculated to effect the imme- diate objects indicated by our letter of the 13th of May.
In obedience to your Grace's commands we have taken this matter into consideration, and have the honour to
Report
That we have perused and considered the Draft Bill enclosed in Sir Frederic Rogers' letter, and we approve of the same as being calculated to effect the immediate objects indicated in our letter of the 13th May.
We have, &c. (Signed) WM. ATHERTON.
ROUNDELL PALMER
His Grace the Duke of Newcastle, K.G.
