EXPLANATORY REPORT on Ordinance No. 27 of 1890 entitled An Ordinance "to provide "for the payment of grants out of public funds in support of the Established "Church of Scotland, the Church of England, and the Roman Catholic Church in "Mauritius, and for the distribution of such grants."

This Ordinance was passed to give effect to the recommendations contained in the report on the distribution of the Ecclesiastical Grants adopted by the Council of Government on 12th August last, which has been already sanctioned by the Secretary of State.

I HAVE the honour to enclose for Her Majesty's most gracious confirmation and allowance Ordinance No. 31 of 1890 for constituting the Presbyterial Committee of "the Church of Scotland in Mauritius into a corporate body, and to make provision for "the control and management of any property the Church of Scotland may now possess

or may hereafter acquire in Mauritius or its dependencies."

2. The enclosed copy of the Procureur-General's report dated the 19th instant explains the object of this Ordinance.

Be it enacted by his Excellency the Governor, with the advice and consent of the Council of Government, as follows:-

1. On and after the passing of this Ordinance the following persons being office- Presbyterial bearers and adherents of the Church of Scotland in Mauritius, viz. :-

Robert Freeland, Esquire, Chairman.

Reverend George McIrvine, M.A.

J. J. Le Brun.

Dr. C. Meldrum, C.M.G., LL.D., F.R.S. Messrs. D. D'Avoine,

E. Dupuy,

James Rae,

H. C. Smith,

Jean C. Suzor,

Théodore Le Bon,

C. Fenegan,

James Forrester Anderson,

Louis Jacques, Treasurer,

Murdo McDonald,

David C. Standley,

William McIrvine, Secretary,

shall be members of the Presbyterial Committee, which is hereby constituted a corporate body under the style of the "Presbyterial Committee of the Church of Scotland in Mauritius."

The said corporate body shall have a common seal. It shall act, sue, and

be sued under its corporate name, service of process on the chairman or on the secretary being equivalent to service on the said Presbyterial Committee.

2. The members of each of the congregations of the Church of Scotland in Mauritius Membership. shall have the right to appoint in each year not more than two of their number to represent them with full powers as members of the Presbyterial Committee, and respec- tively to fill up any vacancy that may occur through the death, absence, resignation, or incapacity to act of one or more of such members. All ministers and missionaries of the Church of Scotland in Mauritius shall be ex-officio members of the Presbyterial Com- mittee, and the election of chairman, secretary, and treasurer shall be in every case subject to the approval of his Excellency the Governor. The congregations having at present the right to appoint representatives as above stated are those of:

Grand River,

*AN ORDINANCE enacted by his Excellency the Governor of Mauritius and its Depen- dencies, with the advice and consent of the Council of Government thereof.

For constituting the Presbyterial Committee of the Church of Scotland in Mauritius into a corporate body, and to make provision for the control and management of any property the Church of Scotland may now possess or may hereafter acquire in Mauritius or its dependencies.

30th December, 1890. desirous that the Presbyterial Committee of the said Church should be constituted into a corporate body having defined powers of control and management as respects the material and secular interests of the Church of Scotland in Mauritius and its dependencies:

3. The general management of all existing places of worship, schools, or buildings for Powers of the residence of ministers, or for charitable purposes shall rest with the minister and the Presby- office-bearers of the respective congregations, but in future all further sums contributed trial Com towards similar ends shall vest in the Presbyterial Committee, and shall be allocated by it according as it may deem necessary for the purposes implied in the title and preamble of this Ordinance. The power to invest, sell, mortgage, or exchange any property or portion thereof belonging to the congregations of the Church of Scotland in Mauritius, and also the power to acquire property shall, after the passing of this Ordinance, vest in the Presbyterial Committee alone.

5. All contributions paid by Government to the Presbyterial Committee in trust inter vivos shall be applied towards the payment of clergymen, missionaries, and catechists employed and logacies. for the time being by the Church of Scotland in Mauritius; and all other income and Government property placed at the disposal of the Presbyterial Committee in trust shall be applied and others solely towards the promotion of the lawful interests of the said Church, and no portion thereof shall be paid or transferred directly or indirectly by way of dividend or bonus or
