Downing Street, July 8, 1872.

IN reply to your letter dated the 21st June, respecting the settlement of accounts between the Government of India and that of the Straits Settlements, I am directed by the Earl of Kimberley to state that Governor Sir H. Ord will be instructed to lose no time in having a case prepared setting forth the position of his Government with respect to those accounts for submission to the Arbitrator, and his Lordship presumes that the Duke of Argyll will give directions for the preparation of a similar case on the part of the Government of India

Downing Street, August 9, 1872. IN my letter of the 8th ultimo I informed you, by desire of the Earl of Kimberley, that the Governor of the Straits Settlements had been instructed to prepare a case for arbitration on the disputed matters of account between Her Majesty's Government and the Indian Government.

Lord Kimberley thinks it may be convenient that the selection of an arbitration should now be made, and his Lordship would propose, for the Duke of Argyll's concurrence, that the Right Honourable W. E. Forster, M.P., who it is understood would be willing to give his services in this matter, and whose selection could not fail to give satisfaction to all parties concerned, should be invited to act as Arbitrator.

I AM directed by the Duke of Argyll to acknowledge the receipt of your letters of the 8th July and 9th August last, as to the disputed matters of account between the India Office and Colonial Office,

in respect of the transfer of the Straits Settlements to the latter Government.

In reply I am to state, for the information of Earl Kimberley, that the Secretary of State in Council acquiesce most willingly in the proposal that the Right Honourable W. E. Forster should be invited to act as Arbitrator in this matter.

I am to add that his Grace has entrusted the preparation of the India Office case to Sir Charles Jackson, Auditor of Indian accounts.

THE remaining portion of this letter is as follows:-

"His Grace wishes to be informed whether it is proposed that the Arbitrator be empowered to

call witnesses, or whether his decision is to be based on the documents, reports, and correspondence to be laid before him, and whether he is to be empowered to call for the arguments of Counsel, which is

is suggested would be expedient, and whether, after the cases are interchanged, either party is to bố at s liberty to file a further case in reply.
