(b) in the opinion of the Director. such publica- tion is desirable for the purposes of--

(i) cnforcing a provision of these regula- tions;

(ii) investigating а suspected offence

against these regulations; or

(10) investigating a suspected offence in

respect of a certificate or an application for or use of a certificate; or

(c) the person identifiable by the information or to whom the information relates consents

in writing to publication of the information."

Explanatory Note.

(This Note in not part of the regulations, but it intended rp indicate their general purport).

Regulation 9 of the principal regulations at present prohibits the publication of any information which is obtained from an application by a person to be registered as eligible to receive certificates issued under the regulations if the information relates to, or is identifiable with, any person or the goods dealt with by him, unless be consents to the publication.

2. It is proposed to replace this regulation by a new provision prohibiting the publication of information which is obtained from such an application and which discloses the identity of any person or the nature of any goods dealt with by him, unless the Director of Commerce and Industry gives permission for the publication.

1. The Director may only give such permission if-

(a) the information is supplied either to trade promotion organizations or in reply to trade inquiries and is limited to the name and address of the person concerned and the fact that he is dealing with a particular product;

(8) in his opinion, publication is desirable for the purposes of

enforcing the principal regulations or of investigating suspected breaches or offences, or

(c) the person to whom the information relates consents in writing

to its publication.
