EMERGENCY REGULATIONS ORDINANCE.
(Chapter 241).
EMERGENCY (PRINCIPAL} (AMENDMENT) (NO. 4) REGULATIONS 1967.
In exercise of the powers conferred by section 2 of the Emergency Regulations Ordinance, the Governor in Council bas made the following regulations--
1. These regulations may be cited as the Emergency Citation. (Principal) (Amendment) (No. 4) Regulations 1967.
1. Regulation 88 of the principal regulations is revoked and replaced by the following-
"Criminal proceedings may be held E camera,
and non- disclosure of identity of witnesses in certain cases.
88. (1) Notwithstanding any other law-
(a) if it appears to a court that it is or may be expedient so to do in the interests of justice or public order or security or for the safety or well being of any witness or for any other reason; or
(6) if a court is satisfied on the information of any person or otherwise that a witness is apprehensive as to what may happen to him or to any member of his family or a friend or to his property or business if he gives evidence in open court,
the court may order that the whole of the proceedings before it in respect of any offence shall take place in a closed court.
(2) Notwithstanding that proceedings are taking place in a closed court pursuant to an order under paragraph (1), if the court is satisfied that a witness is apprehensive as to what may happen to him or to any member of his family or a friend or to his prop- erly or business in consequence of his giving evidence, the court shall not permit any question to be put 10 the witness or any other witness if the answer thereto would lead, or would tend to lead, to disclosure of the Dame or address of such first-mentioned witness, but the court may require such witness to record his name and address in writing and deliver the same into the custody of the court.".
