38. The authorized architect appointed in respect of any building works or street works shall give such periodical supervision and make such inspections as may be necessary to ensure that such works are being carried out in general accordance with the provisions of the Ordinance and regulations and with the plans approved in respect thereof by the Building Authority and with any order made or condition imposed, pursuant to any provision of the Ordinance or regulations in that behalf, by the Building Authority.

39. The authorized architect appointed in respect of any building works or street works shall submil to the Building Authority, within seven days of his receipt thereof, any notice to the Building Authority delivered to him, in accordance with the provisions of regulation 24, by the registered contractor appointed in respect thereof.

40. Where, on the completion of any building works or street works, more than one inspection thereof is, in the opinion of the Building Authority, necessary by reason of any contravention of the upon comple- provisions of the Ordinance or regulations or by any incorrect informa- tion, the authorized architect appointed in respect thereof may be required to pay the prescribed fee in respect of every such additional

41. (1) The registered contractor appointed in respect of any building works of street works shall, before the commencement of such works, sign and deliver to the Building Authority an undertaking in the prescribed form.

(2) Every such undertaking shall be deemed to be an assumption by the registered contractor of responsibility for strict compliance with provisions of the Ordinance and regulations.

42. The registered contractor appointed in respect of building works shall keep on the site of the building works, and shall produce to the Building Authority at such times as he requires, all plans of the building works supplied to him, in accordance with the provisions of plans on site. regulation 37, by the authorized architect appointed in respect thereof.

43. The registered contractor appointed in respect of building works or street works shall, during the carrying out thereof, give con- tinuous supervision thereto to ensure that the building works or streel works, as the case may be, are carried out in accordance with the provisions of the Ordinance and regulations and with the plans approved in respect thereof and with any order made or condition imposed, pursuant to any provision of the Ordinance or regulations in that behalf, by the Building Authority.
