Liability of principáls.

7. Any person who authorizes another person (hereinafter referred to as the agent) to act for him in relation to anything required to be done under any of these regulations shall be liable for the acts and omissions of the agent, and may accordingly be prosecuted for any offence committed by the agent with respect to any such act or omission in the same manner as if he had himself committed the offence, but shall not be sentenced to imprisonment unless he actually consented to the commission of the offence:

Provided that nothing herein shall relieve the agent from liability to prosecution.

In exercise of the powers conferred by section 3 of the Miscellaneous Licences Ordinance, the Governor in Council has made the following regulations-

Explanatory Note,

(This Note is not part of the regulations, but is intended to indicate their peneral purport).

These regulations provide for the issue, endorsement, control and regulation of Imperial Preference Certificates. They enable the Director of Commerce and Industry to issue nod endorse the existing form of certificate to enable the importation of goods manufactured, processed or produced in the Colony into any part of the Commonwealth and Empire under claim to Imperial Preference rates of duty. The Director is also empowered by the regulations to appoint, suspend and remove accountants approved by him for the purpose of preparing Imperial Preference costings, Regulation & creates offences and provides penalties therefor. By virtue of the provisions of section 68 of the Criminal Procedure Ordinance, Chapter 221, the proof of lawful authority lies on the person charged with an offence. By regulations 6 and 7 a person may be rendered liable for the acts of his partners, agents, etc.
